Withdrawal information

Withdrawal information

1. Content of the right of withdrawal

The Customer is entitled to withdraw from the contract without giving a reason within 14 calendar days of receiving the product. In the case of several products, the withdrawal period starts from receipt of the last product received.

2. When does the right of withdrawal NOT apply?

Pursuant to Section 29 (1) of Government Decree 45/2014 (II. 26.), the right of withdrawal does NOT apply to the Customer in the following cases (only those relevant to the webshop are listed from the full enumeration):

  • a contract for a product produced on the consumer’s instructions or at their express request (made-to-measure pieces);
  • a product that clearly has unique characteristics tailored to the consumer’s person.

Important for our webshop: for items orderable from a photo and shipped from stock, the right of withdrawal applies in full. However, if you order a product made to custom measurements or to a custom request (e.g. a personalised colour combination, size, stitching), the right of withdrawal does not apply to it — you will receive separate information about this before placing the order.

3. Exercising the right of withdrawal

The Customer may exercise the right of withdrawal in the following ways:

  • By e-mail: by a declaration sent to info@ladymhungary.com matching the model below, or by any other clear statement;
  • By post: by a declaration sent to the Service Provider’s address (9082 Nyúl, Tavasz utca 14., Hungary).

The declaration must be dispatched by the last day of the 14-day period; for meeting the deadline, the date of dispatch counts.

4. Model withdrawal declaration

(Copy the model declaration into a blank e-mail or letter, fill it in and send it to one of the contact details above.)

5. Returning the product

After sending the withdrawal declaration, the Customer is obliged to return the product to the Service Provider within 14 days, to the following address:

The product must be returned in flawless, original condition, with the original tags and packaging (where possible).

6. Cost of return

The direct cost of returning the product is borne by the Customer. The Service Provider is unable to accept parcels sent cash on delivery.

7. The Service Provider’s refund obligation

The Service Provider refunds the amount paid by the Customer (including the shipping cost, except for any additional cost arising from a delivery method other than the least expensive standard method chosen by the Customer) within 14 days of receiving the withdrawal declaration.

The Service Provider makes the refund using the same payment method as the original (in the case of a bank transfer, to the Customer’s account number). The Service Provider is entitled to withhold the refund until the Customer has returned the product or has proven beyond doubt that it has been returned.

8. Depreciation of the product

The Customer is liable for any depreciation of the product if it results from use exceeding the use necessary to establish the nature, characteristics and functioning of the product. Trying on (as in a clothing store) does not qualify as such use; longer-term wearing, washing or alteration does.
